Legislative Update - June 17, 2010

A-2722 (Burzichelli, Rumana, Quijano, Caputo): On June 17, the Assembly Regulatory Oversight and Gaming Committee released A-2722 Aca, which modifies processes for contested case hearings by the NJ Office of Administrative Law. The goal of the bill is to streamline controversies and disputes in Administrative Agencies. Specifically, the bill would eliminate Commissioner review of ALJ decisions, allow witness testimony by phone, and permit oral ALJ decisions. NJEA testified in opposition to the bill and expressed concern that the bill removes too many protections for litigants. The bill was unanimously released from the Committee and is now on second reading in the Assembly where it may or may not be posted on the floor for a vote.
