“’Unfair Wage Recovery Act”; provides that unlawful employment practice occurs each time individual is affected.”

NJEA supports A-4124 (Lampitt, Riley, Moriarty, Mosquera) in order to combat the persistent income gap that is attributable to systemic gender discrimination.  Specifically, this bill provides that an unlawful practice of discrimination in compensation is committed each time that compensation is paid.  This legislation will provide women with another tool to achieve pay equity in the workplace.

This bill is largely based upon the Lilly Ledbetter Fair Pay Act, federal legislation which was signed into law on January 29, 2009.  Passing a state law that refers to New Jersey’s Law Against Discrimination will provide employees with an added protection against paycheck inequalities.

NJEA supports this bill because fair pay is critical to women's economic security, particularly in the current economic crisis.  In 2011, women made 77 cents to the man's dollar.  According to the U.S. Bureau of Labor Statistics, the median wages of full-time, year-round workers in 2008 stood at $35,745 for women and $46,367 for men.  And, according to a new report by the Center for American Progress Action fund, the average woman stands to lose $434,000 in her lifetime because of pay discrimination.
