S-2

“This bill clarifies the powers of LUARCC to recommend the consolidation or merger of specific municipalities and autonomous agencies and the sharing of services between municipalities or between municipalities and other public entities.”

NJEA is opposed to S-2 (Sweeney, Kyrillos, O’Toole).  This bill clarifies the powers of LUARCC to recommend the consolidation or merger of specific municipalities and autonomous agencies, as well as the sharing of services between municipalities or between municipalities and other public entities.

NJEA is concerned about S-2 because:

  • Under the provisions of this bill, municipalities would be penalized with a reduction in State aid if the municipality does not implement a recommendation of the Local Unit Alignment, Reorganization, and Consolidation Commission (LUARCC) within 14 months. 
  • In addition, the bill also makes a number of changes that affect employees of local units that enter into a shared services agreement - - most notably, local units would no longer be required to provide employees terminated for reasons of economy and efficiency with: 
    1. Terminal leave payment;
    2. The Civil Service Commission would no longer be required to review employment reconciliation plans; and
    3. The protective provisions of Title 11A, Civil Service, of the New Jersey Statutes, would not apply to the employees affected by a shared services agreement or joint meeting.

For the reasons identified above, NJEA asks you to oppose S-2.
